Judges Overreach, Trump Officials Cry Foul
Within 90 minutes on Wednesday, districts in Tennessee and Maryland issued orders keeping Abrego Garcia in federal custody and barring ICE from taking him into removal proceedings.
DHS Assistant Secretary Tricia McLaughlin blasted the rulings on X as “LAWLESS AND INSANE,” declaring that this “unhinged judge” is trying to tie the hands of ICE even as it pursues a hardened gang member indicted for human trafficking.
“He will never walk America’s streets again,” McLaughlin vowed.
Trump Team: Ready for Battle
Justice Department sources confirm the administration is exploring every legal avenue—appealing to the Sixth Circuit, and if necessary, seeking emergency relief at the Supreme Court. A senior official told Fox News Digital, “We won’t let activist judges thwart the will of the people or undermine our laws. We’re fully prepared to defend our authority to deport dangerous criminals.”

The Law Is on ICE’s Side
Under federal immigration statutes, ICE has broad power to arrest and remove non-citizens convicted of aggravated felonies or subject to gang-related charges—regardless of where criminal proceedings began.
Last month, DOJ attorneys made clear in Maryland that Abrego Garcia’s handoff from U.S. Marshals to ICE would happen “immediately” after his release from prison. Now, Trump officials insist that any court-mandated delays are purely political, not legal.

Former White House adviser Stephen Miller applauded the administration’s stance:
“This is about border sovereignty and public safety. No more excuses—no more loopholes. Judges who let MS-13 operatives roam free are cozying up to criminals, not protecting Americans.”
Senator Tom Cotton called on Attorney General Bondi to file an emergency application at SCOTUS if lower courts continue their “judicial sabotage.”
