Another Obama Judge Tries to Block Trump’s America-First Border Plan

An Obama-appointed judge just handed a win to illegal immigrants and the radical open-borders crowd, blocking President Donald J. Trump’s latest executive order to shut down asylum claims from those “invading” across the southern border.

Trump’s Proclamation: Shut The Back Door

On January 20, President Trump issued a no-nonsense proclamation aimed at cutting off asylum and withholding claims from migrants who cross the border illegally, calling it an “invasion” that must be stopped to protect America’s security, jobs, and sovereignty.

The goal was simple: End the exploitation of loopholes by cartels, traffickers, and economic migrants flooding the border.

But U.S. District Judge Randolph Moss, appointed by President Obama, blocked Trump’s move, claiming the president “lacks the inherent constitutional authority” to override asylum and withholding statutes under federal law.

The ACLU and Activists Cheer, America Loses

The lawsuit, pushed by the ACLU and a collection of migrant advocacy groups, argued that Trump’s order was “unlawful” and “unprecedented.” Moss agreed, stating in a 128-page ruling that allowing Trump’s policy would render “much, if not most, of the INA simply optional.”

The ruling certifies a “class” of migrants who would have been impacted, allowing the lawsuit to proceed under the newly narrowed Supreme Court rules from Trump v. CASA.

“An appeal to necessity cannot fill that void,” Moss added, ignoring the humanitarian crisis and national security risk posed by an overwhelmed border.

Trump’s Team Slams ‘Marxist’ Judicial Meddling

Trump adviser Stephen Miller torched the decision, labeling Moss a “Marxist judge” on X:

“To try to circumvent the Supreme Court ruling on nationwide injunctions, a Marxist judge has declared that all potential FUTURE illegal aliens on foreign soil (eg a large portion of planet earth) are part of a protected global ‘class’ entitled to admission into the United States.”

The Trump administration will seek emergency relief and appeal the case, with Moss pausing his order for 14 days to allow the challenge.

A Pattern of Judicial Obstruction

This is just the latest example of the activist bench working overtime to stall Trump’s America First policies:

  • Judges blocked Trump’s prior asylum restrictions.
  • They attempted to halt his travel bans.
  • They are trying to undermine birthright citizenship reforms currently before the Supreme Court.

Even as Trump’s administration has used wartime immigration law to deport violent offenders and gang members, activist judges have consistently slowed or blocked removals.

The Stakes Are High

President Trump has made it clear: America’s border will be secured, and the days of illegal crossings leading to automatic asylum are over. This ruling is a speed bump, not a stop sign.

As Trump continues to fight for stronger borders and American jobs, activist judges and the radical left will do everything they can to keep the floodgates open.

But if Trump has proven anything, it’s that he doesn’t back down. The appeal is coming, and the fight for a secure America isn’t over.
