In another episode of courtroom theatrics and headline-chasing, the government of El Salvador told the United Nations that President Trump’s administration “retains custody” over Venezuelan migrants housed at El Salvador’s maximum-security CECOT prison.
Naturally, the corporate media and activist lawyers are using this to launch another round of legal attacks against the Trump administration’s decisive border actions. But let’s cut through the noise.
What El Salvador Actually Said
According to filings, El Salvador claimed the “jurisdiction and legal responsibility” for the roughly 300 deported migrants “lies exclusively with the U.S.” under a $6 million hosting agreement signed in March.
This statement, part of a U.N. human rights inquiry driven by the ACLU and allied groups, is now being weaponized in U.S. courts, with Judge Stephanie Gallagher demanding explanations from the Trump administration.
But here’s the thing: these “human rights” groups and activist judges have opposed Trump’s immigration enforcement at every step. They have never cared about the American families victimized by cartel violence or the fentanyl pouring across our borders.

Now, they’re latching onto bureaucratic phrasing from El Salvador to sabotage lawful deportations of suspected gang members, including Tren de Aragua operatives, who endanger American communities.
Trump’s Hands Are Tied? Hardly.
The anti-Trump spin is that the administration has “no power” to continue deportations or to prevent returns because El Salvador “says” the U.S. holds custody. But what’s really happening is that these activists want to undermine Trump’s constitutional authority to secure our borders and protect Americans.

President Trump’s administration invoked a 1798 wartime immigration law in March to fast-track removals of illegal Venezuelan nationals—a law used sparingly but lawfully to protect national security.

Now, Judge Gallagher and others are using the El Salvador statement to pressure Trump officials to “explain themselves.” One case involves a deportee identified only as “Cristian,” whom Gallagher ruled was deported in violation of a prior DHS settlement. She claims the administration’s answers are like “nailing Jell-O to a wall.” Meanwhile, activist lawyers are salivating at the chance to transform this procedural squabble into a full-scale assault on Trump’s successful deportation efforts.
If these judges were as diligent in protecting American families as they are in protecting foreign nationals with questionable backgrounds, our communities would be far safer.
Let’s Be Clear: Trump Is Right
President Trump has consistently said, “We will deport criminals, protect American families, and stop the invasion at our border.” The notion that El Salvador’s statement somehow reverses the administration’s legal and moral duty to enforce our immigration laws is laughable.
We should be asking: Why are these foreign nationals here in the first place? Why do activist lawyers work so hard to keep suspected gang members in the U.S.? Why should American taxpayers and families bear the burden of policies that prioritize non-citizens over our own people?

As President Trump’s border policies continue to yield results—record low border crossings, cartel arrests, and deportations of dangerous criminals—the left needs a new angle. Now, they are trying to claim “jurisdiction confusion” to block removals and resettle deportees in the U.S.
But make no mistake: this is not about human rights. This is about stopping Trump from doing what he promised—putting Americans first.
El Salvador’s statement changes nothing about Trump’s America First commitment to law, order, and border security. The activists and judges pushing to unravel deportations under the guise of “jurisdiction” are the same people who have opposed every meaningful step to protect American sovereignty.
The real scandal isn’t that Trump is enforcing the law; it’s that entrenched activist networks, aided by a compliant media, will twist any foreign government statement to undermine your safety.
